Terms of Service & Risk Disclosure
Version 2026-04-29 — please read in full before creating an account.Digital Summit is a self-service marketplace for digital files paid in cryptocurrency. All payments are irreversible and we have no ability to refund, reverse, or recover funds sent on the blockchain. By creating an account you accept full responsibility for the wallet addresses you use and the transactions you sign.
1. Service Description
Digital Summit (“the Platform”) connects creators (“Sellers”) who upload digital files with users (“Buyers”) who purchase those files using cryptocurrency. The Platform charges Sellers a flat 7% platform fee on each completed sale, billed monthly. Buyers do not pay any platform fee directly.
2. Eligibility
- You must be at least 18 years old (or the legal age in your jurisdiction).
- You must not be located in, or be a citizen of, a jurisdiction where cryptocurrency trading or digital marketplace activity is prohibited.
- You must not be on any sanctions list (OFAC, EU, UN, etc.).
3. Cryptocurrency Risk Disclosure
- Irreversible transactions. Once a blockchain transaction is broadcast, it cannot be reversed by the Platform, the Seller, the Buyer, or any third party. If you send funds to the wrong address you may lose them permanently.
- Price volatility. Cryptocurrency exchange rates can change significantly within minutes. The fiat (USD) value displayed at the time of purchase or invoice generation may differ from the value at the time the transaction is confirmed.
- Network congestion and fees. Confirmation times and miner / gas fees are determined by the underlying blockchain, not by the Platform. We do not refund unconfirmed transactions or pay miner fees on your behalf.
- Underpayment. If you send less than the required amount (beyond the small tolerance window), the Platform will mark the order as underpaid. We do not deliver assets for underpaid orders. Refunds of underpaid amounts are at the sole discretion of the recipient and are not facilitated by the Platform.
- Overpayment. If you send more than the required amount, the asset will be delivered but the surplus will not be refunded automatically. Contact support for case-by-case review.
- Wrong network / wrong address. Sending USDT on the wrong network (e.g. ERC-20 to a TRC-20 address), or sending any cryptocurrency to an address of a different chain, will result in permanent loss of funds. The Platform cannot recover funds sent on the wrong network.
4. Seller Obligations
- You own all rights to the content you upload, or have a valid licence to sell it.
- You will not upload illegal content (malware, child sexual abuse material, infringing copyrighted works, sanctioned content, doxxing material, weapons instructions, narcotics, or any content that violates the laws of your jurisdiction or ours).
- You are responsible for declaring and paying any taxes on your earnings — the Platform does not withhold or remit taxes on your behalf.
- You must keep your receiving wallet addresses up to date and secure. The Platform displays a warning if you list assets without configuring a wallet — you remain solely responsible for your own wallet keys.
- The Platform charges a 7% fee on completed sales, invoiced monthly. Failure to pay the invoice within 30 days will freeze your seller account (assets hidden, uploads disabled) until the invoice is paid.
5. Buyer Obligations
- You confirm you have the legal right to purchase and use the content in your jurisdiction.
- You will not redistribute, resell, or sub-licence purchased content unless the Seller’s licence explicitly permits it.
- You accept that purchased downloads are delivered as-is and the Platform does not validate file contents, quality, or fitness for any particular purpose.
6. No Warranty / Limitation of Liability
The Platform is provided “as is” and “as available” with no warranty of any kind, express or implied. To the maximum extent permitted by law, the Platform’s aggregate liability to any user for any claim, however arising, is limited to the platform fees we received from that user in the 30 days preceding the claim. In no event are we liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, data, or cryptocurrency, regardless of the cause.
7. Indemnity
You agree to indemnify and hold harmless Digital Summit, its operators, and its affiliates from any claim arising from your use of the Platform, your uploaded content, your purchases, your tax obligations, or your violation of these Terms.
8. Account Suspension and Termination
We may suspend or terminate any account at our sole discretion, including (but not limited to) accounts that:
- Upload prohibited content (see §4).
- Have unpaid platform fees overdue more than 30 days.
- Are flagged for fraud, chargeback abuse, or suspected money laundering.
- Are operated from a sanctioned jurisdiction.
Suspension and termination decisions are made by a platform administrator. If you believe a decision was made in error, you may appeal by contacting support within 14 days. The administrator's decision on appeal is final.
9. Privacy and Data
We store the minimum data needed to operate: your username, email, password (hashed), wallet addresses you choose to provide, the assets you upload, and the orders you place. We do not sell your data. Full details are in our Privacy Policy.
10. Communication
By creating an account you consent to receive transactional emails (order confirmations, underpayment warnings, invoice reminders, password reset requests). We do not send marketing emails without separate explicit opt-in.
11. Changes to These Terms
We may update these Terms by publishing a new version on this page. The version string is shown in the header above and recorded against your account when you accept. Continued use of your account after a new version is published constitutes acceptance of the new terms.
12. Dispute Resolution and Governing Law
Step 1 — Contact support. Most issues are resolved quickly by emailing support@digitalsummit.com. We aim to respond within 5 business days.
Step 2 — Platform admin decision. If direct correspondence does not resolve the issue, either party may escalate to a formal platform administrator review. The administrator's written decision is final and binding for all disputes arising from Platform operations (including but not limited to asset delivery, underpayments, account suspension, and fee invoices). By accepting these Terms you waive the right to challenge an administrator decision in court for any claim with a value below €500 EUR.
Step 3 — Governing law. These Terms are governed by and construed in accordance with the laws of the Republic of North Macedonia. For any claim that proceeds beyond Step 2, you irrevocably submit to the exclusive jurisdiction of the competent courts of North Macedonia. The Platform is operated by an individual based in North Macedonia and makes no representation that the Platform or its content is appropriate or available in all jurisdictions — access from jurisdictions where the Platform's operation is restricted is at the user's own risk.
